<![CDATA[MARTINSBURG � A jury awarded a Berkeley County couple more than a half-million dollars in damages against Dan Ryan Builders at the end of a civil trial Wednesday. The building company was found liable for flooding in the couple�s basement. The jury�s judgment awarding the couple approximately $514,000 in damages, including $131,000 for punitive damages, came more than a week after Circuit Judge Christopher Wilkes sanctioned the company by directing a verdict of liability for what he described as �egregious and willful failures� to follow the rules of discovery and civil procedure. �These matters are taken very seriously by the court,� Wilkes told Dan Ryan Builders� attorneys on Tuesday, March 11. �....if the rules aren�t followed our whole jury system fails.� Specifically he found them liable for negligence, breach of contract and maliciously, willfully and intentionally trucking in thousands of tons of dirt the couple�s attorney argued caused continued flooding of the basement. Kirk Bottner, the Charles Town attorney who represented Robert and Caroyln Hurdle in the case, said he thought Dan Ryan Builders was playing a game of �hide the ball� throughout the course of the case by being unable, or unwilling to provide specific documents pertinent to his clients� claims. �From the beginning they seemed to feel that they had the right to determine what evidence we were entitled to,� Bottner said. �It was just a long list of failures in doing what they were supposed to do that led to the judge directing the verdict.� The jury, besides awarding the damages, found the company liable for wrongful concealment, meaning they concluded that Dan Ryan Builders failed to disclose flooding issues on the property when the couple purchased the home. The jury deliberated for about two hours last Wednesday before returning with a decision on the amount of damages following eight days of testimony over the course of two weeks. Dan Ryan Builders had previously offered $25,000 to settle the case. �We�re absolutely thrilled that there is a public finding of fault by Dan Ryan Builders and not only fault but intentional, willful and malicious conduct because for five years they maintained they didn�t do anything wrong to harm these folks,� Bottner said. Dan Ryan Builders was represented by Macel Rhodes, of the Zimmer Kunz law firm. �While we respectfully disagree with the findings of the trial judge, we do appreciate the jury�s effort in sorting through this very complex matter. This case involved a flooded basement of a home during extreme weather conditions in 2003. The house was built in 1999,� Rhodes said. �Dan Ryan Builders remains committed to providing all of its customers with high quality homes.� The Hurdles purchased the home located at 114 Good Street within the Sycamore Village subdivision in 1999 for about $260,000. In February 2003, 25-26 inches of snow fell on the subdivision followed by heavy rains. The rain combined with the melting snow led to the Hurdles� 1,700 square foot finished basement to flood that March and it remained flooded until July. While Dan Ryan Builders contended that the flooding was a result of the extreme weather, Bottner presented evidence that the company knew the property where Sycamore Village is located was flood prone before they purchased it and that the act of trucking in thousands of tons of dirt to raise elevations, as well as the use of pumps to drain flood water into a nearby storm water management pond, caused the continued flooding of the Hurdles� basement. The basement itself was located within 50 feet from the 215 home storm water management pond. The area where the home was built also has a high concentration of limestone, which over time water, which is acidic, seeps through. �In 1998 we had pictures of the pond full of water and the area of where my clients� home would be built underwater,� Bottner said. �What happened out there was an overall increase in the ground water table. This is an area that is very prone to flooding.� Among those who testified on the Hurdles� behalf was a local resident who has lived nearly her entirely life across the street from the subdivision. She, Bottner said, told the jury that the property had been flooded for as long as she could remember. Additionally, Bottner showed jurors planning commission files of citizens complaining about the approval of the subdivision and flooding in the area. Bucky Teach, the county�s engineer, who testified as a witness for Dan Ryan Builders said that about 20 years ago, before he was the county engineer, he was going to make the property into a mobile-home park because he said he knew of the issues there, according to Bottner. �He said it was going to be a mobile-home park. (He said) I made it a mobile-home park because I knew we couldn�t have any basements out there,� Bottner said. �... There was actually testimony in the trial where Dan Ryan Builders said they felt no responsibility whatsoever to these people that they had sold homes to. Not just our clients, there are other people in there that flooded.� Bottner said he firmly believed they intentionally chose to ignore the flooding issues when they developed the land. �They thought they�d get away with it, fortunately in this case they didn�t,� Bottner said. ]]>

These were old shotguns passed down in my family for 3 generation, a 12 gdg double, Damascus barrel, a 1920's century arms double, 2 old 12 gdg singles, (one with a hand carved stock by my grandfather) and a Uberty 6 revolver 357 mag. (looks like colt 45) Also taken was a Holland & Holland shot gun case of redish brown leather and camel canvas. This long case is rare, expensive looking and in new condition. and would not be your normal case. It was an anniversary present. These items were very important to me. We know who took the guns and will solve that problem shortly, but I am afraid the guns will not be recovered. We believe they were fenced in or around the Clayton NC area within the last 3 weeks. I will pay a substantial reward for information leading to the recovery of any of the guns or case. A Stihl backpack leaf blower was also taken and may show up in the same area.
